SARS, like HIV, placed healthcare workers at risk and raised issues about the duty to treat. But philosophical accounts of the duty to treat that were developed in the context of HIV did not adequately address some of the ethical issues raised by SARS. Since the next epidemic may be more like SARS than HIV, it is important to illuminate these issues. In this paper, we sketch a general account of the duty to treat that arose in response to HIV. (...) Our purpose is not to defend or criticise this account, but to show that it needs to be developed in order to address three important issues. The first issue concerns how risks should be distributed among healthcare professionals. The second issue concerns the conflicts that arise between professional duties and family duties. The third issue concerns the forms of support that societies owe healthcare workers during epidemics. Our descriptions of these issues are drawn from our experience of the SARS epidemic in Taiwan. In discussing whether legal systems are necessarily coercive, legal philosophers usually appeal to thought experiments involving angels or other morally driven beings who need no coercion to organise their social lives. Such appeals have invited criticism. Critics have not only challenged the relevance of such thought experiments to our understanding of legal systems; they have also argued that, contrary to the intuitions of most legal philosophers, the ‘man on the Clapham Omnibus’ would not hold that there is law in a (...) society of angels because the view that law is necessarily coercive ‘enjoys widespread support among laypersons’. This is obviously an empirical claim. Critics, however, never systematically polled the ‘man on the Clapham Omnibus’. We boarded that bus. In July 2002, I had the honour to be invited to give a 15 minute presentation on behalf of my country, Taiwan, on the topic of “Current system of national guidance on human subject protection in medical research” in a panel discussion of the Forum for Ethical Review Committees in Asia and the Western Pacific , World Health Organization international conference held in Chin-Mai, Thailand. Various models have been used to “emplot” our collective experience of the COVID-19 pandemic, including the epidemiological curve, threshold models, and narrative. Drawing on a threshold model that was designed to frame resource-allocation decisions in clinical care, I offer an ethical justification for taking caring responsibilities into consideration in such decisions during pandemics. My basic argument is that we should prioritize the survival of patients with caring responsibilities for similar reasons we should prioritize the survival of healthcare professionals. A long overdue translation of Schopenhauer's 1913 thesis, the only philosophical work of the corpus not previously available in English. The translation, which keeps a fine balance between readability and philosophical accuracy, is accompanied by a commentary enabling students as well as established scholars to follow Schopenhauer's thought with comparative ease.

The ArgumentThe thesis of this paper is that there are three basic processes by which a technological innovation is fitted into an existing culture: Rejection, in situations where all interested groups are satisfied with a traditional technology and reject apparently superior innovations because they would force unwanted changes in technology and ideology; Acceptance, in situations where a new technology is embraced by all because it appears to serve the same social and ideological functions as an inferior, or inoperative, traditional technology; (...) and — most commonly in complex societies — conflict over acceptance or rejection, in situations where a new technology introduced or proposed by one group, who perceive it as advancing their interests, is resisted by another group, who perceive it as threatening their welfare. A traditional tripartite concept of culture is employed, distinguishing technology, social organization, and ideology. Four case studies are introduced to illuminate the issue: the Thonga tribesmen of Mozambique, whose occupation as gold and diamond miners at first suited perfectly the requirements of the Thonga lineage and marriage system; the Yir Yoront of Australia, an aboriginal group who found that the steel axe introduced by whites disrupted the patriarchal status system and confounded their mythology; the Senecas, an American Indian tribe that for generations rejected male plow agriculture because their way of life was organized around female horticulture, but who took up male agriculture at the urging of a prophet when traditional male roles disintegrated on the reservation; and the anthracite miners and mine operators of nineteenth-century Pennsylvania, who discovered that fundamental changes in both social organization and ideology were needed in order to cope with catastrophically high rates of industrial accidents attendant on the new system of deep-shaft mining. In an essay on pantheism Schopenhauer observes that his chief objection against it is that it says nothing, that it simply enriches language with a superfluous synonym of the word “world.” It can hardly be denied that by this remark the great pessimist, who was himself an atheist, scored a real point. For if a philosopher starts off with the physical world and proceeds to call it God, he has not added anything to the world except a label, a label (...) which, if we take into account the ordinary significance of the word “God,” might well appear unnecessary and superfluous: one might just as pertinently say that the world is the world as that the world is God. Neither the Jew nor the Christian nor the Moslem understand by “God” the physical world, so that, if someone calls the physical world God, he cannot be taken to mean that the world is God according to the Jewish or Christian or Moslem understanding of God. Does he mean any more than that the physical world is ultimately self-explanatory, that no Cause external to the world, no transcendent Being is requisite or admissible, i.e. that there is no God? If that were all there is in pantheism, the latter would indeed be indistinguishable from atheism, and those who called Spinoza an atheist would be fully justified. (shrink)

Towards the close of Book V of theRepublicPlato tells us that the true philosopher has knowledge and that the objects of knowledge are the Forms. By contrast, the ‘lovers of sights and sounds’, he tells us, have no more than belief, the objects of which are physical particulars. He then goes on to present us with some very radical-sounding assertions about the nature of these physical particulars. They are bearers of opposite properties, he says, in so thorough-going a manner that (...) we cannot say of them that they are nor that they are not: they lie somewhere between being and utter non-being.This passage of theRepublic still awaits an agreed interpretation and I want to suggest as a reason for this that it is usually interpreted in isolation. I will argue that it becomes easier to understand when seen against the background of Plato's developing thought. To be more precise, it makes sense when taken as a rejection by Plato of one of his earlier beliefs: namely, a doctrine of essentialism to be found in thePhaedo.The greater part of this paper then will be an attempt to show thatRepublicV is a rejection of thePhaedo'sdoctrine of essences. Its concluding part will try to explain why that doctrine was rejected. (shrink)
